MODELOS DE POLÍTICAS PÚBLICAS PARA MITIGAR IMPACTOS E PROMOVER UMA TRANSAÇÃO JUSTA
Abstract
The technological revolution has brought challenges to the labor market, requiring the development of
public policies that mitigate the effects of automation on employment and ensure a just transition for
workers, in accordance with constitutional principles. The objective of this study was to analyze the
regulation of artificial intelligence in the Brazilian labor market, evaluating public policy models
capable of mitigating economic, social, and legal impacts and promoting a just transition in the face of
the changes brought about by these technologies. A qualitative and exploratory approach was adopted,
combining a literature review with documentary analysis, using national and international legislation.
The study analyzed the regulation of artificial intelligence in the Brazilian labor market and its economic,
social, and legal impacts. Based on the international experiences analyzed, it was found that Brazil must
prioritize the implementation of effective mechanisms for governing artificial intelligence in labor
relations, aligned with the constitutional principles of human dignity, the social value of work, and social
justice. It was found that automation increases inequalities and structural unemployment, requiring
public policies for reskilling and digital inclusion. Although Bill No. 2,338/2023 represents progress on
this issue, effective mechanisms to protect workers in the face of the advancement of Artificial
Intelligence are still lacking. The conclusion is that the regulation of AI in the workplace is under
construction and must be guided by digital ethics, transparency, and the protection of fundamental rights
to mitigate its social impacts, so that technological innovation becomes an instrument of social justice.
