Os desafios no enfrentamento à pornografia infantil na era digital, e a aplicação das leis nos crimes virtuais

Abstract

Technological developments have brought many benefits, such as increased interaction and information sharing, but they have also facilitated the emergence of cybercrimes, such as child pornography and digital pedophilia. This study analyzes the difficulties in preventing, investigating, and protecting against these crimes in the virtual environment, marked by anonymity and transnationality. The research, of a qualitative nature, is based on bibliographic and documentary analysis, covering statistical data, scientific articles, legislation, and regulations. It explores the relationship between the application of current laws and their ability to deal with the complexity of these crimes, highlighting regulatory gaps and the need for legal and technological improvements. The results indicate that the slowness in gathering evidence, combined with insufficient resources and specific regulations, contributes to the impunity of offenders and the vulnerability of victims. It is concluded that the challenges in combating child pornography are complex and require constant adaptation of laws and monitoring tools, in addition to strengthening international cooperation and the use of advanced technologies to protect children and adolescents in the digital environment.
