DOMESTIC VIOLENCE AND THE EFFECTIVENESS OF THE ENFORCEABILITY OF THE MARIA DA PENHA LAW
Abstract
The present study deals with domestic violence in its social context, as well as Law 11.340/2006 (Maria da Penha Law) and its analysis, which expanded the rights related to full protection to women, but made it difficult to implement such protection due to the numerous peculiarities in concrete. The law came to offer better support to victims, through quick and agile responses to reports of aggression. The protection of women is ensured through protective measures, which are used when the victim is facing violence and unbearable contact with her partner. Throughout the research, the effectiveness and applicability of the law are addressed, as well as the real reasons for the non-significant decrease in cases, after years of the enactment of the aforementioned law. In addition to the criticisms, the concept, types of violence, and legislation relevant to the subject will be presented.
