Abstract

ABSTRACT

Talking about the process of disintrusion of indigenous lands over time makes us reflect on the conceived right and the unacquired right. The Constitution enshrines indigenous peoples as the first natural lords of the lands. It establishes new milestones for a harmonious relationship between the State, Brazilian society and indigenous peoples. The core of this article is to analyze these disintrusion processes designed for the Karajá People of Aruanã-Go. The general objective of the discussion is to understand the struggle for land rights in the face of the omission of protection and defense by the State. We will also seek a legal partner interpretation of the processes that constitute the Karajá from Aruanã-Go Indigenous Land, so our premise was to understand the probable legal partner and ethical obstacles that stand in the way of the realization of the right to land and its removal. As we know throughout the history of indignou peoples, it is perceived that territorial rights have been usurped. Finally, this research will be guided from the bibliographical and documental research, they will be the support for the data triangulation.
