PARENTAL ALIENATION: reflections on false accusations of incest

This article aims to contribute to Civil Law in the sphere of family relations, with the purpose of stimulating knowledge about Parental Alienation, in order to extinguish Parental Alienation Syndrome (PAS), to clarify what this syndrome is and its possible signs. Parental Alienation is a demoralizing campaign that disqualifies the person of the parent, bringing serious psychological consequences to the alienated and the child/teenager used as an instrument of disaffection, with the objective of distancing both. Thus, in this article, we pay attention to one of the tricks that the alienator uses as means to obtain its result, which is the false accusation of sexual abuse by the other parent. Two subjects so opposed from each other, almost antagonistic, as incest and parental alienation, will be discussed the course of this article, we will see the and to show measures to prevent eventual future practices, besides seeking to protect the right of the child and the adolescent to a healthy family relationship. At the end, the penalties applicable to cases of Parental Alienation were studied in accordance with the Law 12.318 of 2010, which regulates and deals with this issue.
