The legal impacts of Law 13.146 / 15 on the Civil Code and other legislation in the Brazilian context

Abstract

Through the study of the transmutations of Brazilian law due to the promulgation of a specific document that protects the rights of people with disabilities, which is the Statute of People with Disabilities (Law 13.146/15), an analysis is necessary to understand how are these rights protected and how this law impacts on the existing of normative provisions. The legal provisions, which was not endowed with effective applicability, brings innovations aforementioned from the law that have considerably changed important conceptions of the legal order, which will be addressed in this work. Throughout the study of Law 13.146/ 15 and its reflection in the legal system, this research presents the effects of the referred legislation in the Brazilian scenario, in the face of a large part of the population still unaware of it or even knowing it, not being aware of it or even effective, which puts in doubt about what would be the major obstacle to the effective applicability of the Law: the people themselves or the lack of even stricter sanctions against discriminatory conduct.
