Abstract

Obstetric violence means any practice that restricts the rights and freedom of the parturient, such as the examination of excessive touch or verbal and physical abuse. The occurrence of obstetric violence violates the fundamental rights guaranteed in the Citizen Charter of 1988, transgressing medical care while in fact it is a criminal practice, and may even fit several types of criminal. The present study has as its main scope the analysis of the possible causes of obstetric violence and its forms of prevention and / or eradication, assuming that this practice directly violates the legal system, especially the current Federal Constitution and criminal law. The methodology used in this research was the deductive research method, through the literature review. It is concluded that one in four women suffer obstetric violence before, during or shortly after childbirth, and because it is a latent issue in society, several bills are being submitted to the National Congress aimed at curbing such practice and clarifying women's rights. prevention and eradication of obstetric violence.
