Abstract

This paper aims to analyze the border control in a historical way before doing a parallel with it, between state discretion and its limit with human rights. After, the text seeks to bring these notes to the Brazilian reality. By this way, it becomes possible to understand the importance of all literature that serves as a framework for the refugee issue and what limitations each country may have in choose to the privilege life and the social welfare over refugee. Posteriorly, it was realized an overview of all legislation supported by Brazil, as well as about our performance in the international scenario. Lastly, appears the requirement to list the specific situation of Covid-19 and how the country had been dealing with it before the pandemic and after it appears.
